The appeal filed by the Allied Peoples Movement (APM), challenging Fubara’s victory as the ruling governor of Rivers State had been dismissed by the Supreme Court.

The counsel for the APM, Innocent Kere, during the proceedings opted to withdraw the appeal, leading to its dismissal by the Supreme Court in the last state gubernatorial election as the five-member panel led by Justice Kudirat Kekere-Ekun reserved judgment on the appeal filed by Tonye-Cole and the APC after all parties in the suit adopted their briefs of arguments.
